Question about Non Custodial parent supplying medical insurance NY STATE?
Here is the deal. Hubby has 2 daughters from previous marriage(11&12). Due to their mother damanding he gave her sole custody. He pays court ordered child support weekly. Was ordered to provide health care if available at reasonable cost. His daughters had Medicade up until recently when their mother got a job. Lost coverage. Dad put daughters on his health insurance (was recently changed by his employer and is within the reasonable limit set by the court). His ex called last night and told us to take them off the insurance because he is not allowed to supply insurance due to the fact that she has sole custody. NY state medicade told her this. How can this be if it is court ordered? They told her that she has to get insurance for the daughters. They said that by dad having them on his insurance it is a HIPPA violation because he doesnt have custody therefor isnt entitled to any of their information. PLEASE remember dad gave her sole custody on her request…. it was not TAKEN from him

Well I am in NC and I tried to drop my sons insurance from his father because my husband has insurance on him. They told me that if it was court ordered to put them on the insurance, it has to be court ordered to take them off. Call your attorney and ask them.

This is definitely real lawyer question. No one but a lawyer could untangle the real answer buried within bureaucratic bumbling.
Only other option is to get same court that oredered hom to pay med premiums to modify their original order releasing him fro medical obligations of payments, but also ordering he be provided with all info about his daughters health issues.
